WASHINGTON, DC / ACCESSWIRE / February 10, 2023 / Yesterday, 29 patient, provider, and consumer organizations representing a wide range of illnesses and health conditions filed an amicus brief in support of a case brought against the U.S. Department of Health and Human Services by the HIV+Hepatitis Policy Institute , the Diabetes Leadership Council , the Diabetes Patient Advocacy Coalition , and three patients. Filed in the U.S. District Court for the District of Columbia, the lawsuit challenges the federal 2021 Notice of Benefit and Payment Parameters rule, which allows health insurers to avoid counting the value of drug manufacturer copay assistance toward patients'' out-of-pocket cost obligations. Plaintiffs recently filed a motion for summary judgment, asserting that the rule violates cost-sharing requirements mandated by the Affordable Care Act and is also arbitrary and capricious. The amicus brief organized by Aimed Alliance demonstrates how copay accumulator policies acutely harm the patient community.

(Image by HeungSoon from Pixabay ) By Katelynn Richardson Daily Caller News Foundation Texas Attorney General Ken Paxton filed a lawsuit against President Joe Biden’s Department of Health and Human Services (HHS) Tuesday over the agency’s guidance mandating pharmacies provide abortion pills regardless of state law. The HHS issued the guidance in July 2022, citing federal anti-discrimination law and threatening to pull Medicaid and Medicare funds from pharmacies that do not comply. The lawsuit argues that the guidance contradicts the Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization, which found no constitutional right to an abortion and kicked the ability to pass regulations back to the state level. “The guidance makes clear that as recipients of federal financial assistance, including Medicare and Medicaid payments, pharmacies are prohibited under law from discriminating based on race, color, national origin, sex, age, and disability in their programs and activities,” the HHS wrote last July.
